What is Local Law 97?
Local Law 97 is one of the most ambitious building emissions laws in the United States. Passed as
part of New York City's Climate Mobilization Act, it sets strict limits on the greenhouse gas
emissions of large buildings and imposes significant financial penalties on properties that exceed
those limits.
Buildings are responsible for approximately 70% of New York City's total carbon emissions. Local Law
97 is the city's primary mechanism for changing that.
Who Does It Apply To?
Penalty Structure
Penalties are calculated at $268 per metric ton of CO₂ equivalent that a building emits above its annual cap. A building that exceeds its cap by 100 metric tons faces a penalty of $26,800 per year — assessed annually until the building is brought into compliance.
Phase 1: 2024–2029
Initial emissions limits. Many buildings are already in violation or close to their cap.
Phase 2: 2030–2034
Significantly tighter limits.
Phase 3: 2035 and beyond
The most stringent limits, pushing toward near-zero emissions.
